TOKYOPOP Pocky Art Competition!

 

Official Rules

 

The Sponsor of this Competition is TOKYOPOP Inc.

 

1.     NO PURCHASE NECESSARY TO ENTER OR WIN. The TOKYOPOP Pocky Art Competition (“Competition”) is open only to legal residents of the 50 states of the United States and the District of Columbia who are at least 13 years old as of the date of entry. Void where prohibited or restricted by law. Employees, contractors and their families of TOKYOPOP Inc., and its parent, subsidiary, and affiliated companies are ineligible to win.

 

2.     The Competition begins at 12:01 a.m. PST on April 17, 2009, and ends at 11:59 p.m. PST July 1, 2009. Entries submitted after 11:59 p.m. on July 1, 2009, are ineligible to win. You can only enter this Competition by meeting all requirements in these Official Rules and by:

 

a.     using your existing profile or creating a new profile (which is free) at www.tokyopop.com;

 

b.     creating up to three pieces of original Pocky fan art (e.g., drawings and/or photos), each including at least one image of Pocky (such as a box of Pocky or people enjoying Pocky) and each at a size of at least 1,500 pixels by 2,100 pixels (another way of saying this is 5" x 7" at 300 DPI); and,

 

c.      uploading your Pocky fan art (your “Entry”) to TOKYOPOP in .jpg file format at http://www.tokyopop.com/Robofish/contest/2703623.html.

 

No other methods of entry will be accepted. Only one entry per person will be eligible, but you may include up to three images in your entry submission provided that the total file size of your entry submission does not exceed 10 MB.

 

3.     You hereby grant TOKYOPOP, Ezaki Glico USA Corporation (“Pocky”), and their successors and affiliates the exclusive, royalty free, worldwide rights in all media now and hereafter known in and to your Entry, including but not limited to (1) all copyrights therein, (2) the right of reproduction thereof in any and all media whether now known and/or hereafter devised, in whole or in part, (3) the moral rights of artists therein, and (4) all rights of manufacture, merchandising, recordation, reproduction, translation, adaptation, display, and exhibition thereof in whole or in part, including the right to make modifications thereto and derivatives thereof, in any and all media whether now known and/or hereafter devised and by any and all means or methods. The rights you are granting TOKYOPOP and Pocky include the right to add to, subtract from, arrange, revise, adapt, rearrange, and make variations of your Entry and to obtain copyright in your Entry in the name of TOKYOPOP and/or Pocky. Without in any way limiting the foregoing, you acknowledge and agree that TOKYOPOP, Pocky, and its successors and assigns will have the right to freely sell, license, assign, and otherwise transfer any and all of the rights granted by you to TOKYOPOP and Pocky hereunder and to exercise all such rights in connection with advertising, publicity, promotional materials, and distribution rights in connection with your Entry.

 

4.     TOKYOPOP is not responsible for human error, computer hardware or software malfunction, Internet connection or transmission problems or failures, or Internet traffic congestion, which may affect an entry or attempted entry. TOKYOPOP in its sole discretion may modify or terminate this Competition prior to the stated ending date and time if technical difficulties prevent or delay the running of the Competition or due to fraud, security, or other causes beyond TOKYOPOP’s control.  If the Competition is terminated prior to 11:59 p.m. (PST), July 1, 2009, eligible online entries received prior to termination will remain qualified for the Competition.  All entries must be completed and submitted personally by the entrant. Collection of personally identifiable information will be made pursuant to TOKYOPOP Inc.’s Online Privacy Policies posted at http://www.tokyopop.com/policy/privacy.php.

 

5.     This is a judged competition. Five (5) winning entries – a grand prize winner and four (4) runner-up winners – will be be selected by representatives of Pocky and TOKYOPOP, who will apply subjective criteria including originality, expression, and artistic and technical skills.

 

The Prizes are:

 

a.     Grand prize: $1,000 cash

b.     Four (4) runner-up prizes: each a $20 Borders gift card

 

Prizes are non-transferable. Taxes are the sole responsibility of the winners. If a winner cannot be notified by email or does not accept the Prize within three (3) days after notification has been sent by email, the Prize will be forfeited and a new winning entry will be chosen by the judges.

 

6.     By entering this Competition, you consent to TOKYOPOP’s use of your name for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. If you are the winner, TOKYOPOP may require you to furnish proof of identity, address, and birth date as a condition to awarding the Prize to you. TOKYOPOP may also require you to sign (i) an agreement releasing TOKYOPOP from all liability in connection with personal injury or death, damage, theft, or loss in connection with the Competition and the acceptance, receipt, possession, or use of the Prize, and (ii) a publicity release, unless prohibited by law, permitting TOKYOPOP to advertise your name and state of residence. If you are the winner and you’re under the age of 18, your parent or guardian must also sign such agreements and releases. Failure to present such proof or sign such additional releases within three (3) days after notification by email will result in disqualification and forfeiture of the Prize.

 

7.     The winning entries will be announced at San Diego Comic Con on July 25, 2009, and will be posted on www.TOKYOPOP.com. Prizes will be mailed to winners’ postal mailing addresses in the United States on or about August 25, 2009. The Grand Prize will be awarded in the form of a check drawn on a U.S. bank.

 

8.        By participating in the Competition, you and, if you are a minor, your parents or legal guardians agree to be bound by these rules and the decisions of TOKYOPOP, which are final in all matters relating to this Competition.
